I have sole physical custody and we have joint legal custody. I am recently engaged, and my spouse to be lives out of state. What do we need to do in order for us to move out of state with my soon to be husband? My ex husband is apart of my son's life

There is a "relocation statute" that tells you exactly what you need to do. Basically it involves sending your ex-husband a letter by certified mail setting forth several pieces of information about the intended relocation. The statute allows him a certain period of time within which he may file pleadings with the court objecting to the relocation. In many of these cases the court will allow the relocation provided that adjustments are made to insure significant and meaningful parenting time with the father. Many of these cases are settled by agreement of the parties, but it will be a good idea for you to hire an attorney to represent you.
