Legal Question in Family Law in Missouri
My son got divorced his exwife now got the house. she was supposed to refiance in 90 days. our name is on the loan as of today she still has not got loan in her name.we would like to free out credit up to but another house.talked to lawyer that handle divorced said was nothing we could do.is that true? she sign the divorced papers agree to do what it said.what can we do to get name off loan?

Your son can take his ex-wife back to court on a Motion for Contempt together with a Motion asking for the house to be sold. If the court orders the house sold and is actually does sell, the existing loan might be paid off at the time of sale and you would be free to pursue your other goals. If your names are on the deed to the property, you might also be able to file a lawsuit yourself seeking a "Partition" of the property. In such lawsuits the property is often orderd to be sold.
