Legal Question in Family Law in Missouri

When my son's father and I broke up he started telling me that he would do whatever he could to hurt me, and then started threatening to take Halen away from me. It got to the point that I moved myself with my child to a different town to get away from him and his family. He had me served with an Ex Parte Child Order of Protection this past week and took my child away from me. I have to wait until they hold court to even have the truth come out and won't see my son for thirteen days, and have never been away from him this long. The statements that he swore to be true and signed under penalty of the perjury of the law are all false and I have the documents and evidence to prove so when we go to court. Can I sue him for writing these false statements about me and for signing a false legal statement?

You can file suit. It is impossible to determine the likely success of such a suit without much more facts, and examination of the evidence. You may also try to convince the prosecutor;'s office to pursue criminal false report and perjury charges against your ex.

they will likely not do it, they have chosen to pursue the endangerment charges agaisnt you.
