Legal Question in Family Law in Missouri
My sons father has, twice that I know of, not taken my son to school on half days because he thinks they are pointless. My son already misses enough days because his father cannot seem to get up on the days that he has him. We have a parenting schedule signed by a judge, fyi, so I don't really have any sway as to whether my son stays there or not. Is there anything I can do to make him take him? Should I call the school system and alert them to the reasons why my son misses so much? Lastly, would that be a valid reason to take him back to court and try to get full custody (we have joint now)? Thank you in advance for any answers you can give me.

It is difficult to say whether this behavior would justify taking the child's father back to court on a modification of the existing court order. If the child is missing a significant amount of time at school and it can be shown to be due to the father not being responsible, then it would seem to be in the child's best interest to make some changes. However, as you may already know, litigation can be expensive and there are no guarantees that a court will see everything the same way that we see it. Perhaps if you arrange to consult with an attorney in person and present that attorney with all of the information you have, the attorney will be able to give you a better response. No matter what you decide to do, I wsih you and your child the very best.
