Legal Question in Family Law in Missouri
My step-son recently turned 18 and we filed for termination of child support. He was not going to school and had for all intents and purposes dropped out. However, since we filed his mother re-enrolled him in school for another year.
Besides re-enrollment in school, she is contesting on the grounds that he has a learning disorder. She has had him declared legally disabled and collects SSI for him. He does not require any special care, though she has chosen to stay at home rather than seek employment.
So, what chance do we have of having the order modified, or continued on the condition that he is staying in school and working towards becoming self-supporting? The current order is set for two children, one of which was emancipated three years ago, so we would like it modified. However, we are terribly afraid of having the support amount increased for arbitrary reasons.
