We have verified with the school district my 17 year old daughter has dropped out of highschool, with out any consultation from her mother on our opinion (my new wife and I). We believe she is living with her boyfriend, with no job, not attending school or living with a guardian parent. We have not seen her since April 2010 or her return a phone call, text or email to us since this time, we have only seen her 5 times in two years. Her mother will not admit she is not living at home because wants the child support check. Do we have to continue paying child support or what advice and rights do we have in this situation?

You can file a Motion to Terminate your child support obligation if you believe that the child is no longer living with your ex. Although it might be better to hire an attorney to assist you, you can do this on your own by going to the court house, finding the circuit clerk's office, and asking for assistance. The clerks can not give you legal advice, but they may be able to give you a form Motion and explaing the process. Briefly, your ex will be served with a copy of your Motion and then have a limited time within which to file a response admitting or denying your allegations. If she denies your allegations the matter will be set for a hearing and you will need to be able to offer evidence to support your Motion.
