Legal Question in Family Law in Missouri

Visitation/Support

I moved to the state of Missouri and just before I moved there was a DNA test done on my son to prove that he was the son of this person. The test proved 99.999% that he was in fact. Now he wants to start his visition which is fine, but he wants 50% and he lives in the state of Kansas. When this whole thing started I asked for him to pay legal fees, hospital, insurance, child support, (his share) I have since taking care of all this sine my son was born last year with no help from his father. So I just want to know where I stand as far as him getting 50%, my son is just over 15months.

Re: Visitation/Support

Based on the facts that you have presented I would say it is probably unlikely that he will be awarded 50% visitation. I say this based on the assumption that 1) the child has resided with you since birth, 2) you are not and have not been determined to be an unfit parent and 3)he has not been actively providing support (financially or physically). There is no way anyone can say for certain what a court might do as there are many factors involved and in Missouri/Kansas there is a legislative encouragement of joint custody and for both parents to share financial and decision making responsibilities.

Without knowing more information about your specific situation there is no way for me to be able to tell what the likely outcome will be.

If you would like I am available for a free 30 minute phone consultation and offer very affordable rates for representation with payment plans available. I can be reached at 816-256-4814.
