Legal Question in Family Law in Missouri
My wife has mental problems, in the past she was on crack for 5 years. She left 3 months ago because she could not deal with the responsibility of normal life and our children o 3 and 4 years old. She has threatend to kill herself many times. She has lived other places and can't get along with whoever she lives with. I have had to call the police on one ocasion and they even saw a letter she wrote threatning suicide. The told her to admit herself or they would. I am afraid to let my children be alone with her. She is on dissability and draws 650,00 a month. I only make 30,000 a year and barely get by . How can I get a low colt divorce, and is it possible for me to get full custody of my children? Is it possible that I will have to pay alimony?
1 Answer from Attorneys
It would appear that you would have an excellent chance to be awarded physical custody of your children under the facts you have given. However, if you are going to take the actions necessary to do what is best for your children, then you may have to pay more in attorney's fees, guardian ad litem fees, expert witness fees, and costs than you would like. When a party to a dissolution of marriage suffers from a mental condition, that fact alone may make it necessary to expend additiona time, effort, and money in the case. I would be willing to offer you a free telephone consultation if you would like to cal me at the office. At that time, we can disucuss the legal process and the initial attorney's fees requirements.
