Legal Question in Family Law in Missouri

My wife and i have been separated for 19 years. I used online forms to file in Missouri. My wife had a son in 2002 by another man, unknown. Was denied because in Jan of 2010 court operated rule change the dissolution's and paternity actions must be filed separately. Can I refile without the including the child?

You are legally presumed to be the father of any child born during your marriage. So, you will need to deal with the problem by filing separate Petitions and having the actual father to be judicially determined. These types of cases are better handled by an experienced attorney.
