In that coommunication, they may state that they attend to advise their client to file suit, if they are not satisfied with the result of informal negotiations.

If this patnet attorney is nto admittedto practic law in the state that they are apparently acting like the represnt a party, they shoudl be reported to the bar or supreme court of that state. States seem to be taking aharsher stance on the unlawful or unlicensed practice of law. If this person is your friend, you might remind them that such activity might cause them problems with the patent bar too.
