Legal Question in Family Law in Missouri
The Other Woman
I just recently got married in May of this year. Today, July 2002 I find out that my husband has another woman already. I can't even begin to tell you how devastating this is. Here I thought I was a newlywed. Anyway, I want to divorce, separate or whatever I can. It is my understanding that in the state of Missouri, not only can you sue your spouse for divorce but you can sue the person who interfered in the marriage. Is this true? If so, how can I go about starting the process? I need help!

You're talking about an alienation of affection action. It is possible but not advisable. Proceed with a divorce action. Call for assistance.

Re: The Other Woman
First of all, you have my sympathy for the painful situation you find yourself in at his point in time. It is certainly understandable that you would want to separate from your spouse and file for a dissolution of marriage as soon as possible. It is also understandable that you would want to look into filing an alienation of affection suit naming your spouse's girlfriend as a defendant. I would strongly suggest that you obtain competent legal advice before taking any action. If you are not already represented by legal counsel and you are located in the eastern half of Missouri, I may be able to help you. I have handled several hundred divorce cases over the twenty-four years I have practiced law, and I have had experience with alienation of affection lawsuits as well.
