Child Molestation Charges
I am being accused of a crime that has never happened, my brother's ex-wife is accusing me of doing something to her daughter. They are going through a nasty divorce and a battle of custody between the kids, I don't know why my name is being brought into their nasty dispute, but I'm not about to let her charged me for something that I've never in my wildest dream could ever do. What legal rights do I have, I plan on pursuing this charge and sue her.

Unless you are criminally charged it probably doesn't pay to sue this woman. Most of the time courts view this kind of thing rather skeptically when no one has said anything about it before a divorce action got filed. So do most prosecutors. The evidence (physical and testimonial) has to be there for most prosecutors to charge.
All you'll do at this point is make things worse by threatening to sue. Instead, keep your powder dry and let this blow over. But, above all, if you are summoned to the police station for an interview, do not go without an attorney.
