Legal Question in Civil Litigation in Missouri

emotional damages

I am still struggling a great deal over the affair my husband had 15 years ago. We are still married, it has been difficult but we are trying. I have had tried therapy, medications, I've attempted suicide more than once. I do not know if I will ever be all right, or if my marriage will survive. The quality of my life has been affected greatly. Is there any thing I can do leagaly to the woman who had the affair with my husband. Is there any way at all to hold her accountable for the damage she had done to my life. Has it just been to long at this point? Thank you

Re: emotional damages

No. The Supreme Court abolished the action for alienation of affections and criminal conversation. Sadly there is no remedy, and even if there was, your delay of 15 years in bringing an action would probably be a bar to your claim.

You should consider counseling and medical intervention, and move on with your life.

Re: emotional damages

The Missouri Supreme Court in its wisdom did away with an individual's right to sue another person for alienation of affections a couple of years ago after we had enjoyed having that right for centuries. I do not believe that you could sucessfully sue the other woman.
