Legal Question in Civil Litigation in Missouri
Not sure what this would fall under. But my son was having trouble with bullying/teasing at school. I informed the Principal of this a few weeks ago and she spoke to some of the accused students. Well, naturally the problem still existed while in the halls. On May 23, 2011, again something was said to my son to where he could not take it anymore and walked out of school. I found my son blocks away sitting on a curb crying and depressed. When he returned to school today, the Principal talked with him. My son said she was yelling at him and humiliated him by asking was he �slow in the head�. My son also stated a security guard made a teasing comment to him saying he was being "punked" by a girl. Apparently, they think the situation is comical. She sent my son home because he was afraid to tell her again about the bullying because it was others in the room and they seem to think the situation is funny. Is there any legal way I can go after the school for the behavior of the staff?

You have several avenues. You can bring a formal conplaint to the superintendent, if the school or district have a no-bullying policy. You can make out a police report against those kids that assualted (touched) your Son, and the security guard. You can sue the securtiy guard, the principal and possibly the district for infliction of emotional distress, (and possibly other intientionl or negligence torts) in civil court.
