Legal Question in Civil Litigation in Missouri

Falling tree

A neighbor's live tree fell into my backyard due to an ice storm. It did not damage any property, but it will require a tree company to remove it. Is he liable for this cost or will I have to pay to have it removed?

Re: Falling tree

Trees or branches falling after an ice storm are often considered by insurance companies to result from what they call "an act of God", meaning that your neighbor's insurance company will probably not pay. You might want to contact your own homeowner's insurance company who might pay after you pay your deductible. On the other hand, it might be cheaper to just pay to have the fallen tree removed. Perhaps your neighbor, in the spirit of maintaining good relations would agree to share the expense, but I do not believe your neighbor would be legally obligated to do so.
