Legal Question in Civil Litigation in Missouri
Insurance company playing games in payment to me
I was involved in auto accident and he was ticketed 3 months ago. I have minor injuries with a persistant pain where my seatbelt crossed my lap. His insurance company has paid to repair my car but are balking at what I requested for injury settlement. First they offerred $750 and I said wait for the rest of the doctor bills. The dr. bills were $675. Then I requested $3500 for time off work, dr bills, medicines and pain and suffering. They came back with $1835. I think they are playing games and my next step might be to hire an attorney, but the amount is so low, I am concerned that it would not net me any more than what they are offering. Should I ask them for a higher amount than their recent offer or should I stick to my original amount? SHould I hire an attorney? I came to the pain and suffering figure at 4 times the medical costs. This is what I had been told was reasonable. Is it? thank you for your help. cj

Re: Insurance company playing games in payment to me
Based upon the information you provided, it is difficult to fully evaluate your case. You need to at least consider your medical bills, lost wages, and permanent injury. If your total damages are $675 and you have no significant injury, a $1835.00 offer is probably on the low side of fair. One probably can negotiate a better settlement offer. If you do have a significant injury, I would recommend that you consult an attorney so your case can be analyed in greater detail. The proper evaluation of a case is not based upon a multiplier.
