Legal Question in Civil Litigation in Missouri
What is the appropriate process for eviction for rent and possession in the state of Missouri?
1 Answer from Attorneys
There may be various appropriate processes depending upon the facts. Generally speaking the landlord must give the tenant notice either under the lease terms or under the statutes. Then the landlord files a lawsuit and has the tenants served. Then the landlord or the landlord's attorney appears in court and obtains a judgment against the tenants, either by default, consent or trial. After obaining a judgment the landlord can then obtain the services of the sheriff to evict the tenant and possibly to collect any money owed to the landlord.
