Legal Question in Civil Litigation in Missouri
I own property in St. Charles County Missouri. I am not the name on the note (exboyfriend) but I do make all the payments and pay the real estate taxes. He gets in tax writeoff for the interest I pay. I recently tried to refinance through the same bank which holds the note. They stated they needed to contact him for authorization on payoff information. When they contacted him, he refused to give out that information and threatened the bank with a law suit if they offered that information to me. I understand the privacy issue involved, but I have been paying on this for 4 years and would like to get out from under this man. I can't find a lawyer who will handle this case for me without a huge retainer and I have no money to pay for a lawyer. I have contacted Legal Aid, which scoffed and told me it is my own fault for allowing him to do it in the first place. I have also contacted the Missouri Bar Association and the ACLU, in hopes of getting this resolved in a different manner. To no avail. Please offer me a solution to this problem.

Without seeing any of the documents you used for the transactions, it seems that you have a lease or lease purchase agreemnt with your ex boyfriend. The property is his. You have been renting or bouyiung it from him by making the note and tax payments. If you do not posses documents to evidence your purchase of this property, you may have to sue your ex in a quient title action. You might also allege a purchase agreemnt and seek to have the court enforce the agreement. In either case, if he wins, then he might be able to evict you from the property without having to reimburse you for what you paid. It seems for now that he is nto trying to evict you from the property. If you want to go ahead and get the title in your name, you shoudl take whatever documents you have and consult direclty with an attorney in your area. You said that you do not have money for alwyer, but you seem to be paying on anote and taxes. Many attorneys offer a free or low cost initial consultation.
