Legal Question in Civil Litigation in Missouri
I have recently been unemployed, searching for a job for the last 3+ months. I always came close (was even actually hired) but more than a few employers changed their minds at the last minute. I JUST received a copy of a background check done by one of my prospective employers( from almost 5 months ago) and it shows a sexual battery charge for some guy with my name and birthdate (nothing else), in Tennessee (I live in Missouri). I notified the agency doing the check and they said it could take up to 30 days to correct. This in my opinion is gross negligence on their part, the middle name and social are completely different. No telling how many agencies have made the same mistake. A sexual battery charge is a repugnant offense to be labelled with. Is there any recourse I can take?

It sound like you may have a valid claim against this agency. You should consult directly with a civil practice attorney in your area. Many offer a free or low cost initial consultation. They will need to know more of the facts of your situation.
Good luck
