Legal Question in Civil Litigation in Missouri

Am I responsible for re-payment of a loan?

Back in 1996, I was offered a co-publishing agreement with a publishing firm. However, I needed a thousand dollars, of my own to seal the deal. I did not have it. I borrowed the money from my mother, and promised to pay her back. Sadly, she pasted away in 1997.

Two weeks after her funeral, I discover that she had borrowed the money from her friend. If I had known this, I would never have taken the money. I was under the assumption that this was a loan with my mother.

Now, this man, whom I do not even know his full name, is hounding me for the money he claims that I owe him. On several encounters, I have asked him to provide me with a contract of agreement between him and my mother. He has not provided me with that.

If there is nothing in writing, on a debt more than five years old, do I owe this man??

Warmest Regards,

D. Kirch

Re: Am I responsible for re-payment of a loan?

From the limited information in your question, it certainly does not appear that you are legally obligated to pay the man who is demanding money from you anything. If he has a claim, it would be against your mother's estate. I would suggest that you obtain his name and address the next time he contacts you. Then advise him that you do not owe him any money, and that you will contact the law enforcement authorities if he continues to harrass you. If necessary, consult with a local attorney for legal advice.
