we have won a judgement against a business partner he has appealed for a trial de nova it is to be heard in associate circuit court court. Are we able to raise the amount over the $3000.00 limit since it is now in associate circuit court and it is a new trial?

If you can prove that your damages are greater than $3k, then you may be able to obtain a judgment for that larger amount. Depending upon what you claimed in your original complaint, you may need to seek leave to file an amended petition. It is probably time to hire legal counsel to represent you.
