If I terminate a relationship with a current attorney with whom I have provided a retainer, and there remains a positive amount in my account, am I entitled to the money that has not been spent?

Many people overuse the work retainer. It means money you pay so that an attorney will be ready to represnt you. It is not normally refundable, because you elect to change attorneys. It is more common for a client to make a deposit toward future fees, or to pay for representation in one lump sum. In the first case , you are entitled to get all unearned money, when you elect to terminate the representation. If it was lump sum payment, the answer is not as easy. If you signed a written representation agreement, you shoudl examine it o rhave your new attorney explain it to you, as it relates to partial fee retention or refund.

Good luck
