Legal Question in Civil Litigation in Missouri
Trial De Novo Bond And Judgement Amount
My friend was awarded a judgemnt in the the amount of only $1,000 in the local small claims court. He is considering filing a request to raise the amount to a higher amount. It is my understanding that the maximum amount of a judgment awarded in the jackson county, Mo small claims court is $3,000.
He provided documentation at his trial for actual repairs to his truck (damages caused by the defendant) of $1,800 plus approx $600 in other costs.
Can he petition for a judgement of a higher figure using trial de novo? Will he have to post bond?

Re: Trial De Novo Bond And Judgement Amount
Your friend will not lilely have to post bond. He was the victor, the only expense the defendnat would incur would be legal fee sif yoru freind is not awarded more in Associate Circuit.
He should wonder why the judge only awarded $1,000.00 after hearing his evidence. Does he have an independent estimation that makes him believe that he will get more at a ne novo trial? Sometimes people inhis position cannot objectively se that perhaps not all the damges were due to this particular occurrence. Even if he want to go on Pro Se, he might do well to have anattorney evaluate his case.
Good Luck
