Legal Question in Immigration Law in Missouri
Citizenship Denial
I apply for the citizenship on July 07 and they received my package on October 07, I did everything from Finger print and passed the test and the interview, I am working right now as a Gov Contractor in Iraq, I called couple months ago to check on the status and I found out that they denied my citizenship but I dont know the reason yet. I called to find out but they didnt want to tell me the reason on the phone they told me they dont have access to that, I hired a lawyer and she went down there and met with the officer but he or she didnt want to disclose the reason of the denial they told her they will send a denial letter soon and that was in May of 2008, bow it pass mid of August and still I havent heard anything from them. Can someone tell me what should I do so I can know the reason for denying it? I want to appeal the care, because as far as I can think, I have a clean and good record and I was shecked when I hear it has been denied, Please tell me what should I do right now?
Thanks

Re: Citizenship Denial
If you paid the lawyer to investigate and find out what is going on, and you still don't have an answer, then get the lawyer to do it again, for free! You should have received a denial letter with an explanation for the denial, or prior to a denial letter, an opportunity to withdraw your application after hearing the reason for a denial. I believe that your problem is not YOU, but where you are. Where did you take the exam, what is the name of your examiner, and get someone to get into USCIS -- you can only appeal the denial even if you don't know the reason b/c that is probably the reason you are appealing in the first place. Make the government jump and scream around -- your file may be lost for all you know! Demand an answer. Write to the USCIS Headquarters for the Department of Homeland Security in Washington DC. And then followup with a call. Demand that you obtain an answer. As a last resort, you have file a writ of mandamus in federal court and the court will force the agency to give you answer. There may be something more that you don't know about, so I suggest you get going and get that letter. If you want to consult with me on this and what to do and how to do it, please call my office and set up a conference call by telephone. The best of luck to you.
