Legal Question in Immigration Law in Missouri

h1-b

i have h1-b till 2006 june.mw wife has a h-4 till 2006 too.

i change my company and we applied dec 22 , 2003 for me second time h1-b

i think so i will get my new h1-b like may or june 2004.but my wife she want

to visit her family to turkey in june. at this time i have 2 question.

1. after i get my new h1-b ,if she visit her family to turkey,can she come back

she has h4 from my old company till 2006.

2.if we go toogether do i need to american consulate to get new visa ?

There is no need to get a new visa. However, it would be a good idea for her to travel with a copy of the I-129 and the approval notice for your H-1B so that she can show that the principal has maintained his status.

When you go to Turkey...if the new approval already happened....while coming back your passport will be stamped with the new visa. In any event carry all the approval letter, I-94, etc. with you. Also, start the labor certification process with your new company.
