Legal Question in Immigration Law in Missouri

Hi. I got married on October 2013 and got my Temporary residence in April 2013 for marrying a US Citizen, the problem is that the few times we have had a discussions he talks about divorce and that I would have to go back to my country and I married for love and I don't want a divorce but I would like to make sure that I'm not conditioned by my marriage anymore. because I feel like at anytime he may ask for divorce and I will lose everything. somebody told me that I could fill form I-360 but I don't want him to go to jail, he has not abused and he would never do that but I would like to remove my conditions so I can no longer be scared of being deported if he wants the divorce.

Since you already have a greencard, you are not eligible to file form I-360. However, if he leaves you before you file the I-751 to remove the condition of your residency (which should be filed about Jan 2015, based on the brief information you have provided), you must file for a waiver of the joint filing requirements.

For more information on this, see: http://www.uscis.gov/green-card/after-green-card-granted/conditional-permanent-residence/remove-conditions-permanent-residence-based-marriage.

Feel free to call me if you need assistance with this matter.

Thank you & good luck!!
