Generally, most automobile accident cases require the proof of negligence. In Missouri, a driver must use the highest degree of care when operating a motor vehicle on public streets. An instruction to the jury in a case of this nature might look like this:
Your verdict must be for plaintiff if you believe:
First, defendant violated the traffic signal, and
Second, defendant was thereby negligent, and
Third, as a direct result of such negligence plaintiff sustained damage.
It should also be noted that Missouri is a comparative fault state.
