Legal Question in Insurance Law in Missouri

Motor Vehicle Accident

I was stopped in my GMC 2005 Envoy Denali SUV waiting for lady to make her left turn and was rear-ended by 18 wheeler. I was taken to hospital by ambulance and subsquent medical bills were over $8000 which their carrier A.I.G. has not paid. Accident was over six months ago. They paid the replaiar to my SUV over $9000 but have not paid diminished value loss due to bent frame.

Why won't they paid medical bills?

I no longer have neck pain nor continual headache I had for several months. Accident happened over six months ago.

I get veiled threats from Hospital, and medical people frequently.

With such a serious injury and with medical expenses in such an amount, I would very strongly advise you to hire an attorney to present your claim to the insurance company on your behalf. Obviously, the insurance company should pay much more than just the amount of your bills, and you should receive much more even after an attorney is compensated than you will ever receive handling this claim on your own. Most attorneys will take this case under a contingency fee contract so that you would not have to pay the attorney's fees out of pocket. You may need to spend a modest amount of money to obtain complete medical records, but you will recover that expense many times over in the long run. There is a statute of limitations which will prevent you from ever filing suit in this case unless you do so within the time allowed by law. That is not to say that a lawsuit must necessarily be filed, but sometimes the responsible party will stall hoping that you wait too long. Enough time has passed. Please consult with an attorney as soon as possible. If you do not already have an attorney, you may certainly call me for a free consultation. No matter what you decide to do, I wish you a complete recovery and the very best of luck with the insurance company.

You need to hire an experienced trial attorney, and soon! If the insurance company was not fair with you on your property damage, it is hard to imagine that they will be square with you on your injury claim. You are allowed to pursue your out of pocket expenses, as well as pain and inconvenience losses.

If you have health insurance, submit your medical bills to them- this will protect your credit and keep the health care providers happy. If and when you recover your losses from the truck driver, you can settle up with you insurance at that time, if it is required.
