collecting a judgement

I recently won a court case against my former employeer. He says that he can only pay me through his payroll. I am no longer an employee, can I make him give me a check for the full amount without taxes coming out of it? Or should I just go to the circuit clerk to garnish the companies bank account?

You did not provide a lot of facts. But, based upon what you did provide, I think the former employer is wrong. If you have a money judgement, you can collect it. Collecting judgments is a larger part of my practice.

In order to execute on the bank account, you will need to know the bank where the judgment debtor (your former employer) keeps his money. The Circuit clerk wil nto investigate this for you. You may also execute on other assets.
