Legal Question in Employment Law in Missouri
Electronic signatures on e-mailed timesheets.
Are electronic signatures on timesheets which are e-mailed from an employee's home to the office in which they work legal? I have a team of service repairmen. Every other Monday, they have to come in to sign their timesheets which is very counter-productive to our business. HR says electronic signatures are not legal for the Federal government, in the event we are audited. The purpose for them e-mailing them, is to avoid the 3-4 hour trip to the office. We are currently faxing them, but that has many drawbacks. If electronic signatures are legal, HR will need chapter and verse on the legal end. Please inform as to the law and other options if possible. Thank you.

Re: Electronic signatures on e-mailed timesheets.
There may be a way to solve this problem to make everyone comfortable, your HR folks, you and your employees. I often help companies with very difficult issues like yours.
I cannot answer questions, give legal advice, or quote fee rates over e-mail for several reasons. First, in order to answer questions, I may need to ask you several questions or review documents. Also, because there is no confidentiality with e-mail, some authorities have said that I would be in violation of ethical restrictions. Additionally, if you are already represented, I need to know that in order to ethically render legal advice. Finally, please understand that I make my living rendering legal opinions.
