Legal Question in Employment Law in Missouri

employee making false accusations and not disciplined

My boss had a grievance filed on him stating that an employee saw one of our supervisors performing oral sex on him. I was listed as the witness. This was untrue. After an investigation, the allegations were deemed as false. Does my boss and this supervisor have any recourse as to the employee that made the allegations? I might add that this employee reports to my boss as well as he is the facility manager at this location.

Re: employee making false accusations and not disciplined

Thou shall not bear false witness. Has always been a favored tome. If the boss's reputation or career were damaged in a tangible manner, or they suffered measureable emotional or physical harm, then he may have a claim against the employee. The same is true for the supervisor.

Obviously, there is not enough space here for you to provide enough information to make that determination with certainty. Perhaps you could suggest that either or both of them consult an attorney on their own.

You should make it claer to the complaining employee that you take the inclusion of you in their false accusation seriously, and may have to take action of your own. You do not wna to be entangled in anymore webs of deceit.

Good Luck
