I have to have my gall bladder removed -Dr's orders. I am 2 mo shy of my one yr ann. at work. The HR dept states that I wil have to either resign or be terminated, have the operation then reapply for my job. I am currently paying my health insurance along with disability insurance all through them. What is the point of having disability insurance if I cannot use it? Is this legal? Or is this just a way out of having their insurance company not having to pay for my surgery or disability claim? What should I do? If I have to reapply then I am not guaranteed my position back or my current rate of pay, I will be dropped down to the starting wage. My husband is thinking that this doesn't sound right and we would just like to know what my rights were. Thanks Tracy

You may be able to get a Family Medical Leave Act time off without pay. Your tenure may be a problem though. You need to either call the state wage and hour commission or consult with an employment attorney in your area.
