If you are laid off from a company is the non-compete clause still in affect?

Unless there is some limiting language in the agreement, normally non-competes will be upheld for separation for any reason. However, many non-competes are drafted in a way to be unenforceable in the first place. Make sure the agreement is valid, and if it is, you probably will need to refrain from working in a similar position, in a specific geographic area, for a competitor.
