Legal Question in Employment Law in Missouri

Legality of Compensating with Comp Time

I'm a salaried employee for a technology consulting company. A lot of my work is on night and weekends, and my company used to compensate me with an hour of comp time for every hour worked after normal business hours. The company attorneys advised them to terminate this program, and I lost all of the comp time I had built up. Is it even legal to compensate an employee an hour time off for an hour of overtime or must they compensate time and a half? Is it worth seeking a civil judgement against them if I keep track of all my time?

Re: Legality of Compensating with Comp Time

Although there are few facts included with your question, it appears that you may have a good claim to bring before the Misouri wage and hour division. Generally comp time is paid at the same 1 1/2 multiple as overtime payments, however, employers and employees may sometimes contract to figure it differently. The scarcity of facts make it impossible to tell you now whether you have a worthwhile civil suit. If you are interested, I may be able to give you the name of a good labor lawyer.
