Religious Employment Discrimination
Our daughter has been working for a child care facility now for about 2 years. The business has now changed hands and is now owned by a Licensed Exempt Religious Organization. All employees were told that they would receive a 30 evaluation. Our daughter was brought into a room with a manager and a pastor. She was told how great she is with the children and complimented on the fact that she is very punctual and reliable. The manager then proceeded to tell her that she noticed that our daughter was not a Christian and was not in regular attendance at a church. The manager told her that if she did not accept Christ into her heart that her Job security there would be in jepardy. She also told her that they would not even consider hiring any individual of any other religion other than Chistianity. Is this a legal practice in America? In Missouri particularly? The facts, as you decribe them, connote prohibited religious discrimination. Both Missouri and federal law or guidelines prohibit such discrimination in certain work places. If the employer has just afew employess, the federal guidelines will not apply. But, if they are using fedral funds to operate teh facility, than they are often contractually bound to not discriminate in the way you describe.
If an action is taken to demote, passover for promotion or fire your daughter, she might have a sound basis for a complaint. Since you were not in the room when this conversation took place, you might have the facts a bit distorted. Before you contact an attorney, you might have your daughter describe teh facts for herself. You could always be along to support her. Many attorneys are leary of parents who seem to be pushing acase for their adult children.
