Legal Question in Landlord & Tenant Law in Missouri

What action can be taken against a landlord who withheld the security deposit on an apartment for over four months, until the tenant passed away. Then the landlord wrote a check for the deposit, payable to the deceased party and it cannot be cashed by any of the family members?

The check may be able to be deposited into the decedent's bank account by the putative personal representative. If not the check, and the funds it represents, can become part of the decedent's probate estate.
