Legal Question in Landlord & Tenant Law in Missouri
can you evict a person with a notarized letter without a court date?
1 Answer from Attorneys
That is really more questions thatn you may realize. If a lessor tells the lessee to leave and the do, they have evicted that person without use of the courts. The Police will not assist in evicting a lessee without a court order. Lanmdlords are nto permitted to force a renter out, without use of the courts. But, if a renter stays after they are can be sued for montary damges and eviction. The court may order the renter to compensate the landlord for the cost of the court action, the use of sheriff;s deputioes to evect them and the extra time they stayed. Sometimes this is twice the normal rent, plus the court and execution costs.
That is the case in most situations. If they police have determined that domestic violence or drug activity have occurred at a residence, the eviction is very fast, and may not involve the court until after the person is put out.
Good luck
