Eviction of the disabled
I am disabled my when I moved into government housing in March 2005 my landlady said that my rental assistance would kick in in a month or 2 she asked if I could handle paying the rent till that time I said yes and I paid the rent.Rental assistance did not kick in I talked to her about it she then said it would be 3 or 4 months assistance still has not kicked in.My rent is more than half of my income. Can see legal evict me when we had a verbal contract I held up my part of the contract she has not held up her part of the verbal contract.I have been in this apartment since March 2005 it is now Nov 2005 and she has still not gotten my assistance going she is taking me to court to evict me.I need to know what my rights are as a tenant and a disabled person.

Without more specific information about the type of rental assistance you are talking about, it is dificult to give you any specific advice. Are you saying that you entered into a verbal lease agreement for aspecific amount of rent, and that you beleived that a portion of the rent would be coming from third source? Are you saying that the third source never contributed to your rental payments, and you were not able to pay the entire thing yourself, and got behind in the rental debt to the landlord? If that is the case, the landlord can seek to have you evicted. If you have a written lease agreemnt, it may tell you when the landlord has the right to evict you. If you have kept surrent in your rental payments, despite the third party not contributing, the landlord may not have you evicted now.
Why does it appear that you are depending upon the landlord to secure rental assistance for you. Isn't that your job?
