''eviction of roomate''

''My companion of 16 years has left and is now living with another woman. The house and all assets are in my name. I want him to move all his stuff out asap. He identified himself as a renter on the monthly checks he has written to me. What is the eviction process I have to follow for him and how long does he have to get his stuff out?

This is a tricky area of the law and one where you probably ought to follow the advice of an attorney. If you make an error, even a minor technical one, it may invalidate your eviction. For this reason, its a good idea to see an attorney who practices in this area and have him draft the petition for unlawful detainer and have him take care of getting service of process. That way you can be sure that all the rules are followed.

If you do not wish to do this, go to the missouri statutes (they can be found on line by following the research links at www.mobar.org) and look up the unlawful detainer statute and it will tell you how to proceed.
