Legal Question in Landlord & Tenant Law in Missouri

Hello,

I moved in with a friend (nothing is in writing), but I moved in two weeks before the 1st of January. January's rent is paid, in full. I had to move out two weeks after to help my mom out. I owe him half of utilities still, which I am paying, but he says I owe for next month, even though I am no longer in his home. I never said how long I would live there, either. He also wants to sue me for the two weeks I lived there for free, although, I have proof (via social media) that he said I could stay there for free. So my question is, is he allowed to sue me for February's rent if I am no longer staying there?

There are few bars to someone filing suit. The issue becomes the likelihood that the suit will be successful. In your case, it will come down to the agreement between you two. If you were a month to month renter, you will owe for the second half of Januart, and maybe February. If you were a week to week renter, you probably owe for one week past when you left. If you were a guest, you probably owe nothing. At one point you say there are as nothing in writing, by later say you have proof via social media that you were a guest. Internet postings can suffice as writings, if their authenticity can be shown. If you were to stay for free, why would you owe anything for utilities?

Perhaps you can repost with a clear description of what occurred, someone may be able to advise you through this forum. Or, you could consult directly with a civil practice attorney in your area. For now, the answer is: Yes, he can sue you for the February rent, but not enough is known to estimate the likelihood that he will succeed.

Good luck
