Legal Question in Landlord & Tenant Law in Missouri
My husband John and myself recently entered into a lease/rent to own hose. W e placed a $3000.00 downpayment, we have some credit issues and could not purchase the place outright.
We were to lease for the year, be responsible for repairs everything, in the interim we would work on the credit issues, to get a mortgage. I f after the year we decided not to buy we would forfeit our $3000.00. H ere is the issue we were supposed to move in July 1 2010, But the home . did not pass inspection and we were not able to get the occupancy permit from the city to move in. T his is a requirement where we live. so they must fix the repairs before another inspection can occur. We
have decided this is not for us, besides the fact the house has many repair issues we found out. I want to know since we were never able to move in yet, can we cancel and do they have to give us our money back??
please let us know we need to find another place to live and need our money.

It appears that you are entitle to some ro all of yrou deposit back. However, in Missouri, renters and landlords are afforded wide latitutde to contract regrading residential leases. Look at your lease/loan documents to see what it says about early termiantion. If you do nto find yrou answer there, take all your paperwok to an attorney in your area.
