I am interested in the steps to be taken to break a lease in Missouri.
Two students and parents signed a rental agreement for the school year. One, because of medical reasons and surgery moved back home the other because of changes to his scholarship program is now attending a university across state.
Approx. 5 months left on the lease. The landlord is threatening legal action. Is a 30 day written notice enough??

Whether a lease can be terminated early, by one side, without penalty, is most often determined by the language of the lease agreement. See what yoru lease says about early termination. If there is no provision, then the renters still owe rent, even if they choose to live elsewhere. The one who left for medical reaosns , may have claim that they coudl nto go on with the lease, due to health, and may get excused by the court. The one who chose to study elsewhere, appears to still owe rnet (an perhaps the full rent for noth tenants) Has either of ht renters looked into subleasing the sopace. Perhaps ther are trenaferring student who only need a place for five months. You might consider consulting directly wiht a civil atotrney in your area who can read your lease and give you advice specific to yrou situation.
