Lease Agreement

Our lease date is up 4 January, 2008. Our leasing agency is telling us we have to pay two more months rent for not giving a 60 days notice. The notice is the contract unless we renew it. They are going off the termination clause which is only used for a termination of the contract, but we are not terminating it we are fullfilling it by paying to the date that matched our lease agreement.

You did not ask a question in your posting. I assume you meant to ask, "do I owe for two months rent?" The answer depends upon your written lease agreemtn and amendments. You noted that there was an early termination clause in your agreement. You did nto mention if there wasw a renewal clause or statement in yout agreement. Sometimes it is a seperate paragraph. In some agreements it is merely a statement at the end of the sttemetn of the term of the lease. Look for words like "this agreement [tor tenency] shall renew unless notice is given .... If there is no such cluse or statement, then your assumption that you may leave at the natural end of your lease appears to be correct. If there is any kind of automatic renewal, then you may have to give notice, or pay extra rent.
