Legal Question in Landlord & Tenant Law in Missouri

Marriage and leases

I signed a lease to rent a house in October, and my landlord knew at that time that I was planning a wedding in April. Now, she is saying she is not sure that my fiance can move in. If we go ahead and get married, can she still deny him living here? Is there anything else I can do to possibly be released from this lease so that my soon to be husband and I can live together?

Re: Marriage and leases

Unless the lease gives her the right to say who can live with you, your landlord cannot keep you from living in the house with your soon-to-be husband.

If the lease does say she gets to say who lives there, there is an argument that a lease that excludes a marital partner is probably void as against public policy. The state favors the institution of marriage generally.

Take your lease to an attorney and have him read it carefully. Only when the lease is read in conjunction with your questions can a full and complete answer be given.
