Noisy Neighbors

I'm renting an apartment in a 4-plex on a month-to-month basis after my lease expired 02/2012. A woman and her two small children moved in upstairs and it sounds like a demolition most of the time. The male child runs through the apartment continuously for hours and clearly is getting on a chair (or something) and jumping off of it over and over again. One of the jumps caused my ceiling fan to sway. It's unnerving, and I'm constantly anxious at home. I have complained to the property manager who s/w the tenant but then inferred that I was the problem. The property manager wrote me a letter saying that the tenant was not violating the noise ordinance. Moving would be a financial hardship for me, and I really like where I live--it has everything I need in an area where it's difficult to find good rentals. Is there anything legally I can do to enjoin the upstairs tenant from making me miserable?

You did not mention which city you live in. If the noise occurs after your town's "quiet hours" you can call the police to report the disturbance. If you honestly feel that the child is in danger, you can call the police or children's services. But, other than that there may be little you can do to escape the noise, except move. Hearing your neighbors is one of the trade-offs of paying lower rent in a multi-unit building, for less rent than you woudl pay for asingle family structure.
