Legal Question in Landlord & Tenant Law in Missouri
I recently was looking at an apartment to rent in saint Louis, MO. I really liked it and planned on signing a lease. I actually (stupidly) gave the landlord the full security deposit before signing the lease which he deposited into his account that day. My situation has changed and now I am unable to rent the apartment. I called and emailed the landlord 2 days after giving him my security deposit, and said that I would not be signing the lease and I would like to have my security deposit back. He is refusing to give the deposit back, and I am not sure what I should do at this point. He is saying that he told another couple that he already rented out the apartment and since he lost their business, the security deposit that I gave him does not have to be returned. I did not sign a lease though! Anyway any help you can give me on what I should do and what my rights are in this situation would be greatly appreciated. Thanks!

Either hire an attorney to contact the landlord for you, or sue in small claims yourself.
