Legal Question in Landlord & Tenant Law in Missouri

I am a tenant that signed a one year lease and after that year was up went to a month to month lease. I have know been on the month to month for almost four years and my lanlord it now asking us to sign a year contract again. Is that something they can do> I recieved the notice July 17, 2011 and the new lease has to be signed by July 29th is that even enough notice?

To Answer your question there are a few "what if" questions that might be helpful. What if you agree to the new one year contract? No Problem, either sign the agreement as written now, or negotiate with the landllord for terms you can agree to.

What if you don't want to make a one year commitment? You do not have to. But, the LAnslrod still has the same right to evict you as before. That is, uner the facts s you have described them, he (or you) can end the month to month tenancy with one moth' snotice. So, If on the 29th, you have not signed the agreement, the landlord can tel you to move out, and you must be out by August 31st. If they wait til August 2, to tel you to leave (assuming ren tis due on the first of the month, then you woudl ahve to be out by September 30th. Thw same is true for you, depeding upon when you give them notice. IF by 7/31, you don't owe rent after August 31st. If notioce is given on or after August 1, you owe August and September's rent.
