I am a new owner, Can I ask tenant living there if they have only month by month lease with previous owner. Thank

A tenant without a lease is a tenant "month to month." Month to month tenancy may be terminatd with one months notice. However, you have to be careful about the notice. If rent is due on the first of the month, you have to give notice before the first of the month. So, if the rent is due on December 1, you can serve notice on November 30 that the tenant has one month to vacate the premises, and on December 31, 2006, she must vacate. That doesn't mean she will. If she does not, you can then bring an action for unlawful detainer and possession of the premises.
