Breast Augmentation

My daughter had a breast augment in May. When they did the surgery they burned one of her breasts with one of the instruments. The Doctor said he would fix the damage for free but is not doing much to repair the damage. What is the time limit that she has to sue the doctor for these damages

The general statute of limitations in Missouri for medical malpractice cases is 2 years from the date of the negligent act. There are exceptions to the general rule including an extension of the statute of limitations for minors. I believe that the applicable statute of limitations for medical malpractice (professional negligence) suits is two years from the date of occurance. Although, if your daughter was under 18 at the time she might have two years from her 18th birthday. Also, if the health care provider fraudulently concealed the cause of action so as to prevent the filing of a suit within the time allowed by law, that time might be extended.
