Legal Question in Medical Malpractice in Missouri
Never diagnosed!
Last year my mother had been having problems with numbness and pain in her legs and back well her doctor had x-rays done and nothing was ever done for the situation besides more medications.Well she's been back over and over for these same symptoms so the dr finally sends her to a specialist.He takes one look at her xrays from last year and says she has Spinal Stenosis,and a really bad case at that and that she needs surgery asap.He says she could have been paralyzed if she would have fallen or jerked to hard.He said the dr couldnt have ever looked at the xrays becouse there wasnt a single note on the charts but from the actual radiologist.Thats my question.

I am sorry to learn of your mother's injury. To have a malpractice case, you need two components- neglect and injury. It looks as if there may be neglect in your mother's situation, but fortunately, no injury occurred. "Could have been" is not legally actionable, or at least, it is not economically feasible to pursue a civil action.
You can still report this incident to the Missouri Board of Healing Arts in Jefferson City, and should make report to the doctor or hospital where your mother was initially seen.
